Retreat/Event Chef Terms and Conditions
These terms and conditions (the “Agreement”) outline the rights and responsibilities of the Retreat/Event Caterer ‘L-J Lowy’ (chef) and the “Client”. By engaging the services of the Chef, the Client agrees to be bound by these terms and conditions.
Services Provided:
- The Chef will provide culinary services for the specified retreat/event on the agreed date/s as agreed upon by both parties.
- The Chef will plan menus, source ingredients, prepare meals and serve for the retreat/event.
Dietary Requirements and Allergies:
We cannot guarantee a 100% allergen-free environment as we use some allergens in our kitchen.
- The Client shall provide the Chef with accurate and detailed information regarding dietary requirements, restrictions, allergies, and preferences of the retreat participants when seeking the quotation.
- The Chef will make reasonable efforts to accommodate these requirements and provide suitable alternative options whenever necessary.
- The Chef will maintain proper hygiene standards and ensure that all equipment and utensils used in food preparation are clean and in good condition.
- The Client will provide a safe and clean kitchen area for the Chef to work in, with adequate facilities and equipment necessary for food preparation.
Fee and Payment:
- The Client agrees to pay the Chef the agreed fee for the services quoted.
- A 50% non-refundable deposit will be required to secure the services.
- The remaining 50% must be paid at least 60 days before the commencement of service. Please make this payment, as failure to do so may result in the cancellation of the service.
- For a booking made within 60 days of commencement, a full non-refundable payment will be required to secure the services.
- A quotation is valid for 14 days and will be quoted in Indian Rupees (INR), which can only be paid from an Indian bank account. (Not international transfer)
- Alternatively, If the Chef and Client agree to make the payment in Great British Pounds (GBP) within 14 days, the INR amount must be converted into GBR at the rate shown on XE.com on the day of payment.
- Please be aware that all quotes in INR will be subject to the appropriate GST, which will be payable by the client in addition to the cost of the quote.
Cancellation and Changes:
- Deposits are non-refundable under any circumstances.
- If full payment has been made and the client cancels the event/retreat, the chef may issue a partial refund or agree on alternative dates subject to additional charges and conditions at their discretion. But it should be assumed that any payment made is non-refundable.
Non-provision of services by the chef
- If the Chef can’t fulfil the booking on the event date due to sickness or unforeseen circumstances, they will endeavour to provide the services of an alternative chef.
- If the chef cannot find a suitable alternative chef or alternative service provision, a refund minus any reasonable costs will be given within 30 days. Applicable fees may include, for example, services or supplies already paid for or committed to pay. Also, any refund may take account of currency fluctuation and be amended accordingly.
Changes and amendments to the agreed quotation.
- Any change, amendment, or addition to services will be priced in addition to the original quote and by a separate mutual agreement.
- It should be assumed that any reduction in group numbers or requirements will not reduce charges as the chef has based their quote on the original conditions.
Method of payment
- All payments shall be made in the agreed currency within the specified time frame.
- Currently, it is possible to pay in Indian Rupees (+GST) to our Indian business bank account or pay into our UK account in Great British Pounds.
Indemnification:
The Client agrees to indemnify and hold the Chef harmless from any claims, liabilities, damages, or expenses arising from or related to the services provided, including but not limited to food allergies, dietary restrictions, or any adverse reactions.
Governing Law and Jurisdiction:
- This Agreement shall be governed by and construed by the laws of India. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of India.
- By engaging the services of the Retreat/event Chef, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
Events outside of our control (Force Majeure)
The Chef shall incur no liability to the Client if the performance of the contract is prevented by any cause whatsoever beyond our control and in particular but without prejudice to the generality of the preceding, by an act of fire, flood, subsidence, sabotage, accident, strike, pandemic or lockdown and shall not be liable for any loss or damage resulting therefrom suffered by the Client.
